Examining care injustices

This week in North Philly Notes, Akemi Nishida, author of Just Care, writes about care as an analytical framework to understand the contemporary United States

During the COVID-19 pandemic, we were forced to recognize what was at the stake in the political debates on public healthcare programs such as Medicaid, the overstretched nature of the care labor force, and our own vulnerabilities. We also witnessed continuous fights for social justice including Black Lives Matter and Asian Americans against hate crimes, as well as the development of mutual aid networks to survive together.

Just Care suggests care as a lens to understand these phenomena—and incorporates care as not only an object of study but also an analytical framework. The book examines care injustices where people—whether they are situated as care workers, care receivers, or both—deteriorate under the name of care, when care is used as a mechanism to enhance the political economy and neglect the well-being of those situated as care workers and care receivers. It also addresses care justice, or just care, which occurs when people feel cared for affirmatively and when care is used as a foundation for more-just world building.

Just Care is based on research conducted at the request of disability communities to reveal how the public care services they receive are increasingly becoming money-centered, while they demand these services to be human-centered. Also, as a disabled person, my own experiences of receiving and providing care informed my work.

Just Care considers the experiences of care workers and care receivers under the Medicaid long-term care programs, queer disabled people who participate in community-based care collectives to interdependently support each other, and disabled and sick people of color who engage in bed activism to fight for social change from their bedspaces. By being in conversation with and witnessing care routines, the multiplicity of care became particularly noticeable—it is turned into a mechanism of social oppression and control while simultaneously being a tool with which marginalized communities activate, engage in, and sustain social justice fights.

Here are some key points from the book:

  • When scholars and activists work to dismantle injustices surrounding care activities, they often approach them by looking into solely the labor exploitation care workers experience or the lack of adequate care recipients endure. Instead, Just Care engages in relational analysis to think through how these circumstances are intertwined and mutually witnessed and experienced, as care workers and receivers spend the majority of their daily lives side by side.
  • An example of relational analysis is my tracing of the parallels between the histories of welfare programs for single mothers and families in need, (neo)colonialism and labor migration, and public healthcare programs like Medicaid, from the perspectives of critical race, transnational feminist, and disability studies.
  • This analysis shows that in addition to differences in degrees and kinds of care people individually need, intersecting oppressions including racism, neocolonialism, patriarchy, and ableism shape who is currently pressured to take up caring responsibilities and how their own care needs or disabling conditions are quickly neglected. Such oppressions also make us think of disabled people exclusively as recipients of care and rarely acknowledge their caring contributions to society, let alone how the public healthcare services they receive are rarely adequate and can function to surveil them.
  • Care services for disabled people are primarily planned by centering financial benefits for the care industrial complex and budget suppressions for governments and are not based on disabled people’s needs and preferences.
  • This focus on financial benefits means that well-being of care workers and care recipients become secondary concerns. This leads them to experience mutual debilitation, rather than the presumed idea that one group thrives on the back of the other.
  • Some care workers and care recipients under such debilitating public healthcare services develop interdependent relationships to help one another, in the middle of care-based oppression they experience, by transgressing the strict roles given to them.
  • Disabled people have started care collectives to practice interdependence and based on their insistence that everyone needs care and can provide care. Engaging in interdependence in the middle of a society that values individualist independence is destined to be full of challenges. One challenge they faced is material (to physically meet all the care needs emerging within the group), and another is affective (to make sure conflicts within the group will not affect quality of care).
  • Disabled and sick people engage in social change from their bedspaces, or “bed activism.” Bed activism entails critiquing of intersecting oppressions that manifest in bedspaces and offering visions for a more just world by centering the wisdom of sick and disabled people that emerges from their bedspaces.
  • Bed activism can happen actively, for example, when bed dwellers engage in social change by writing a blog post. It also happens in inactive moments, for example, when they rest in their beds while going through depression, pain, or fatigue. Even those moments inform bed activists about their relationships with their bodies and minds or the social conditions that restrict them to their beds.

We all need care and are capable of caring for others in various ways. When we start from this foundational understanding, how can we each engage in just care or more-just world making through care? Just Care points the way to answering this question.

Caring Beside: Metaphors of Solidarity at the Bedside

This week in North Philly Notes, James Kyung-Jin Lee, author of Pedagogies of Woundedness, writes about “the horizontal ethics of care and politics of resistance” as well as the power that can come from the person lying on the bed.

            

In the epilogue of Pedagogies of Woundedness, I cite the opening scene of Johanna Hedva’s “Sick Woman Theory,” in which they describe listening to the sounds of a 2014 Black Lives Matter protest taking place outside their apartment, while Hedva was consigned to a bed because of a chronic illness: “Attached to the bed, I rose up my sick woman fist, in solidarity.” They then wonder what role ill/disabled people might play in revolutionary activity: “How do you throw a brick through the window of a bank if you can’t get out of bed?” Such a question resonates with a corresponding image that Leah Lakshmi Piepzna-Samarasinha conjures in her essay “Crip Superpowers,” that implores her readers and fellow activists to imagine, “We can community-organize flat on our ass in bed—as what the movement needs most.”

The horizontal body in space and time is the prevailing image of the patient consigned to the hospital bed that animates so much of the crucible of experience that animates physician memoirs, the contrast between the standing, able-bodied doctor hovering over, caring, surveilling, and enacting on the prone one in need of care and thus submitting to such diagnostic colonization. It is this asymmetry of power exemplified in bodily position that motivates both Hedva and Piepzna-Samarasinha to see the bedridden Asian American sick woman as nonetheless agentive. Here, I also take to heart Mel Chen’s meditation on Piepzna-Samarasinha’s insistence on a politics enabled “flat on our ass in bed” by their subtle but trenchant critique of the most widely used phrase to demonstrate solidarity with a cause or community or condition: “The grammar of ableist liberatory fervor is succinctly captured, for instance, in the widespread use today of declamatory campaigns that urge one to metaphorically ‘stand with’ various populations or politicians. Such a metaphor is constructed on the figurative imagining of a literal standing. The question becomes what might it mean to ‘stand with’ a figural group, when standing for wheelchair users, or those chronically ill ‘flat on our ass in bed,’ cannot readily invite such ‘politically aligned’ embodied action.” At the time of this writing, my social media feed is filled with posts that stand with the people of Ukraine, stand with LGBTQ+ kids in Florida and trans children in Texas, and of course all through the pandemic we were ostensibly standing with health care workers toiling in the desperate days and weeks of the worst of the COVID pandemic. I suppose that the lack of shortage of people standing with others is a small testament that wounded, vulnerable people receive some modicum of compassion that isn’t tethered to market forces or transactional expectation.

But Chen’s, Hedva’s, and Piepzna-Samarasinha’s insistence on a horizontal ethics of care and politics of resistance have hit home in ways that exceeded my imagination once the final draft of Pedagogies of Woundedness was locked. The following is a story which I have permission to disclose: a year ago, our older teenage daughter attempted suicide and in doing so revealed that she had been suffering from severe mental illness and associated trauma for years, unbeknownst to me and her mom. What followed was a long flight of various treatments, both outpatient and residential, and our family’s baptism into the world of mental health care. There have been and continue to be moments of crisis that punctuate periods of relative mental and emotional stability, and some rare moments of happiness for my daughter, and for the other members of the family. Early on, I clung to a restitution narrative, but we’re late into this story and I recognize now that my daughter is living a different genre. Early on, I stood over her bed desperately wishing she could join me, despairing that the aggressivity of her depression prevented her from even remaining conscious for hours at a time. Over time, I came to understand that standing with my daughter when she couldn’t get out of bed wasn’t all that much different from the physician’s diagnostic colonization of his patient.

So I’ve tried to shift my body and my metaphor to align with where my daughter is on any given day. On really tough days, as she lies in bed, I’ll sometimes lie on the floor and listen to the quiet sounds of her breathing. At moments when she is able to sit at her desk and is willing to let me into her space, I’ll pull up a chair: sometimes we sit face to face and at others side by side, as if we’re facing the world together. Stories of illness and disability, and the politics and ethics that emanate from these stories, the power that can come from the person lying on the bed, have taught me that there is and must be always more room to imagine solidarity with the vulnerable. Nowadays, I will only stand with people, like my daughter, if they want to stand, and if they give me permission to rise with them, if they let me take their hand into mine.

The Problem with “AAPI”

This week in North Philly Notes, Erin Suzuki, author of Ocean Passages, explains the importance of distinguishing Asian Americans and Pacific Islanders.

Over the past year, the dramatic increase in anti-Asian violence and hate crimes across the United States have drawn public attention to long-standing histories of anti-Asian racism in this country. On social media, the hashtag #StopAAPIHate circulated widely in the wake of reports about increasing numbers of both verbal and physical attacks on Asian Americans in 2020 and 2021, as both mainstream outlets and political figures insisted on racializing the novel coronavirus as both the “Chinese virus” and the “kung flu.” Yet as the term “AAPI” (Asian Americans and Pacific Islanders) moves out of academic and policy circles and into the mainstream of public discourse, it’s also important to know what the term means, where it comes from, and—when used casually or uncritically—how it can work to exclude despite its gestures to inclusivity. 

While many assume that AAPI is the proper or more politically correct way of referring to the Asian American community, the secondary inclusion of “Pacific Islanders” within and alongside the larger category of “Asian American” has a long and contested history. Adopted by Asian American activists and academics during the 1970s and 1980s and governmentally sanctioned as a census category in 1990 and 2000, the category of “Asian Pacific Islander” conflated two already internally diverse groups into a single massive category of people who account for over 60 percent of the world’s population. Although this naming ideally calls for an intersectional politics, a sense of solidarity, and mutual support between a range of communities who have differently suffered from racist policies and stereotypes in the United States, in everyday practice the term “AAPI/API” is most often used as shorthand primarily for Asian American—and more specifically East Asian American—communities. As a consequence, many Pacific Islanders find themselves swept up into discussions that do not directly affect their communities (at best), or that ignore or bury their concerns (at worst). 

The problems of the “AAPI” designation have only become more pronounced in the past year, partly because the kinds of racial violence that Asian Americans and Pacific Islanders experience often take very different forms. As a friend of mine commented, “People aren’t out there punching Samoan grandmas—they wouldn’t dare.” But on the flip side, issues that disproportionately affect Pacific Islander communities are rarely identified as AAPI concerns. For example, during the COVID-19 epidemic, the Pacific Islander population in the United States have suffered from the highest rates of COVID transmission and death per capita of any racial group, yet the CDC’s practice of aggregating that data within the larger category of “Asian or Pacific Islander” obscured these numbers, meaning that the necessary resources were not always set aside or ramped up to address this very specific need. In this case, the inclusion of Pacific Islanders within the larger category of Asian Americanness in fact excluded communities in need from both the public eye and from receiving levels of assistance that should have been mobilized to help. 

As I discuss in Ocean Passages (and as Indigenous Pacific scholars have argued for many, many years), this harmful process of “exclusion through inclusion” has a long and complex history rooted in the ways that many Pacific states—including Hawai‘i, Guam, American Sāmoa, the Marshall Islands and the Federated States of Micronesia—were forcibly “included” into the political jurisdiction of the United States as the nation sought to wage war and engage in trade with Asia. In this sense, histories of anti-Asian racialization have a material, if often overlooked, connection to the colonization of the Pacific Islands. The dispossession and erasure of Native peoples’ claims to their ancestral lands and seas enabled many of the transpacific passages and military interventions that brought Asians into American space. If we want to mobilize against the myriad forms of interpersonal and institutional violence against Asian Americans and Pacific Islanders, we must also engage with how the ongoing colonization of Pacific states continue to differently shape perceptions of and policies towards Pacific Islander and Asian American communities. We cannot allow “PI” to operate as a mere afterthought or addendum to “AA.”

The Political Incorporation of Chinese Migrants

This week in North Philly Notes, Amy Liu, author of The Language of Political Incorporation, recounts lessons she learned studying how Chinese migrants are treated in Europe.

Central-Eastern Europe is not an oft-discussed migration destination. Yet, places such as Hungary are some of the most popular European countries for Chinese migrants. Likewise, the Chinese constitute one of the largest migrant populations—not just in Hungary, but in all of Europe. To better understand the Chinese in Europe, I surveyed over 2500 Chinese migrants in Bulgaria, Croatia, Hungary, Portugal, Romania, and Serbia. I find that while the vast majority still held on to their Chinese passports (Beijing forbids dual citizenship), there is substantial variation in the migrant networks. Some are from parts of southern China with large migrant populations in Europe. These southern Chinese communities have a distinct vernacular that ensures their insularity—not just from the local Europeans but from other Chinese.

Everyone else is resigned to larger, all-inclusive Chinese networks. The diversity of these networks requires Mandarin Chinese—the Chinese lingua franca—to be the operating vernacular. The use of this lingua franca means the average Chinese migrant engages regularly with other Chinese persons from different backgrounds. They also interact with the locals more frequently—whether it is because the locals had learned Mandarin or because the Chinese migrant had learned the local European language. This repeated, regularized diversity in interactions translates into a differential: The Chinese in lingua franca networks were on average more trusting of authorities (6 percentage point differential) and civically engaged (7 percentage point differential) than their co-nationals in insular networks.

The surveys were conducted over a five-year period—all before the COVID outbreak. For over a year now, the pandemic has put the Chinese—those in China proper and its migrant/diaspora population globally—on display. As we begin to return to some post-pandemic normalcy, here are two lessons the Chinese in Europe can teach us.

First, what drives higher incorporation levels among the Chinese in the lingua franca networks (i.e., diversity) is also what undermines it when there is a crisis. When I was doing surveys in Romania, the tax authorities launched a four-month raid of Chinatown. It was part of a larger, national campaign to collect unpaid taxes. Responses to these raids—seen very much as an ethnic attack—varied by networks. Those in the insular networks bunkered down and weathered the storm. Conversely, those in the inclusive networks finger-pointed and demarcated new group boundaries. There was sudden suspicion of anyone and everyone that was different. And here is the irony: Those most hurt by the raids were those who trusted and engaged more before; and conversely, those who had been insular were left relatively unscathed. The troubling implication is that anti-Asian hate crimes—while they do not discriminate against passport color or the generation number—affects those who were better integrated in the U.S. And this makes bouncing back after the crisis subsides even harder.

Second, political rhetoric—even the empty rhetoric—matters. During my research, Hungary—led by Prime Minister Viktor Orbán and his Fidesz party—pursued aggressive nationalist rhetoric. And policies matched the rhetoric (e.g. the border fence). Yet, during this time, Chinese migrant attitudes towards the Hungarian authorities remained consistently high (86% in 2014; 95% in 2018). The interviews corroborated these numbers. Interestingly, even at the height of targeting the Muslims and refugees, Fidesz reached out to leaders in the Chinese community to emphasize the Chinese were not the targets of the xenophobic policies. Similarly, text analysis of Hungarian language newspapers across the political spectrum showed when the Chinese are talked about, it is rarely negative. Even as COVID broke out in Hungary, Orbán refrained from associating the Chinese with the virus. This is in stark contrast to his American counterpart. What the former U.S. president did to link COVID with the Chinese cannot be undone. As the Asian-American community tries to make sense of what happened last month in Atlanta, the Biden administration must exercise caution in what it says and how it says it.

The News of New York City’s Death is Greatly Exaggerated

This week in North Philly Notes, Francois Pierre-Louis Jr. and Michael Alan Krasner, two of the coauthors of Immigrant Crossroads, write about immigrant groups in Queens, New York.

Since the advent of COVID-19 and the exodus of affluent New Yorkers to the suburbs, some people have predicted that New York will no longer be the city that never sleeps. Our book Immigrant Crossroads has shown the contrary, documenting and analyzing the many fascinating dynamics of community and political activism in this unique borough.

For immigrant families that had endured the four years of the Trump administration living away from their loved ones, the Biden presidency brings new hope and renewed optimism that what Queens was already showing to America will continue. That the vibrant growth exemplified by the borough of Queens and temporarily impeded will flourish again.

Since the 1990s Queens has become the urban epicenter for contemporary immigration—a place that boasts immigrants from 140 countries. While Manhattan drew millions of tourists and mega-rich condo buyers, the city’s four other Boroughs saw the influx of working- and middle-class newcomers from every continent. Places that used to be unattractive to developers and commercial interests suddenly became prime real estate and desired places for immigrants and the middle class to live. Queens led the way in this transformation from being an enclave dominated by the white working class to being perhaps the most diverse aggregation of human beings on the planet. Queens has become an epicenter of  immigrant striving, and activism, presenting an alternative to the nativist vision pursued by Trump’s  propagandists and enforcers.

Hollowed out by white flight, in the 1980s and 90s, New York City’s outer Boroughs have been revitalized with the influx of new immigrants from Asia, Latin America, Caribbean and Africa. Neighborhoods such as Flushing, Bayside, and Laurelton have emerged as the epicenter of New York City’s Asian American community. Within a decade, Flushing has become one of the city’s major commercial and banking center for the Asian community. Corona and Jackson Heights became destinations for those from Latin America, and Astoria became the home for Russians and Eastern Europeans and those from the Middle East. All across the borough of Queens, immigrants remade blighted neighborhoods into thriving communities.

As major economic developments took place, new forms of immigrant activism emerged in Queens’ other neighborhoods, a process that is remaking the social, cultural, economic, and political fabric of the city. Take the case of Corona, East Elmhurst, Jackson Heights, and Flushing where seventy-five percent of the residents are people of color. When the City announced in 2012, that it would give away portions of Flushing Meadows Park to private developers as a way to revitalize the local economy, a coalition of community-based groups and faith-based organizations created the Fairness Coalition of Queens to fight the Bloomberg administration’s economic development agenda. Forcing the cancellation of a sterile soccer stadium and other mega projects, the Fairness Coalition asserted its own power and priorities to call attention to the need for affordable housing and the checking of rampant  gentrification.

A similar pattern has developed in national immigration politics. Drawing on a heavily foreign-born population (One-in-two residents in Queens are foreign-born, ranking it second in the nation for percentage of foreign-born residents), activist Dreamer organizations have lobbied successfully for state legislation and led the fight for similar action from the federal government. Among the first set of actions by the Biden Administration are a rash of executive orders and a far-reaching legislative proposal to not only undo Trump’s harsh anti-immigrant policies but to usher in human pathways to immigrant inclusion.

Pioneering efforts on health care accessibility, an issue made salient by the Covid crisis also began in Queens where two city-wide immigrant advocacy organizations successfully organized to pass the Language Access in Pharmacies Act in 2009 and in 2012 mandating pharmacies provide comprehensive translation and interpretation services to patients with limited English proficiency.

As these examples suggest, the true impact of the recent surge of new immigrant groups is complex, contradicting partisan stereotypes and xenophobic pandering. Serious scholarship from varied disciplines reveals the richly textured contributions that resurgent nativism has sought to obliterate. Our volume demonstrates that being an Immigrant Crossroads has led New York City to flourish and suggests a path that the entire country would do well to consider following to revive the national motto, “Out of many, one.”

What’s a mother to do?

This week in North Philly Notes, Leah Ruppanner, author of Motherlands, writes about women who are forced to choose between working and child care.

Emily Tatro is a paralegal working full-time while balancing the demands of three school aged kids. School closures mean she is learning Seesaw, Google classroom, IXL, and RazKids while also writing up legal briefs. She is at the end of her rope.

Emily said: “My everything is suffering and I’m not sure how much longer we can keep this up. As soon as the kids are asleep, I pass out because I’m always bone tired. But, I also feel this pressure to keep up a happy-it’s-all-good face so the kids don’t feel bad or sad or scared because none of it is their fault and I don’t want them to see this pressure.”

Without the support of her mother, she would drop out of work altogether. Working full-time job on top of school closures is unsustainable.

What happens when state governments close schools to stop the spread of a deadly pathogen?

The same as before: mothers step out of employment to manage the care.

My book, Motherlands: How States Push Mothers Out of Employment, shows these patterns are nothing new. Prior to the pandemic, California had some of the highest childcare costs in the nation and some of the shortest school days. Afterschool care? Forget about it—many Californian families need but cannot access afterschool care. These structural impediments mean mothers often reduce work to part-time or drop out altogether.

As Emily says, “Childcare was always hard and now it’s just impossible. In summer, I pay someone to watch the kids and I would lose money on these days.”

These patterns are distinct to many of the states in the heartland where childcare gobbles up less of the family budget, school days are longer and afterschool care is more accessible. The result? More mothers are employed, in part, because they can access more affordable childcare.

As Motherlands shows, California is a gender progressive state and is one of the leaders in the country in empowering women. When women do work, they make more money and have access to higher level professional positions. More women are voted into California’s state legislature and California is one of the few states in the nation that provides its constituents paid parental leave.

So, what is happening here? How can California be both progressive in its gender policies but have some of the worst childcare outcomes?

Motherlands shows states tend to cluster on one of these metrics or the other—either facilitating mother’s employment through childcare resources or empowering women through policies and access to better economic markets. Only a handful of states do both—empower women and provide childcare resources. This means even the progressive states that aim to empower women must do more to support them when they become mothers.

And, now seems to be the time because women like Emily are suffering with closed schools and limited childcare support.

We need employers and governments to invest in, advocate for and execute comprehensive and effective childcare policies.

The pandemic and its impending recession is a major crisis. Within these crises, if we are smart, can come change. Putting childcare as a central policy solution is the only way forward.

Overcoming Isolation in the Great Depression

This week in North Philly Notes, Abigail Trollinger, author of Becoming Entitled, writes about how workers in the 1930’s shed the stigma of unemployment and gained a sense of entitlement, and what we can learn in the age of COVID.

Unemployment is often hugely isolating, even when it happens en masse. It was for workers in 1932, at the height of the Great Depression. And considering recent debates over unemployment insurance, it seems that COVID-related unemployment has left many jobless workers facing economic insecurity alone.

Becoming Entitled: Relief, Unemployment, and Reform During the Great Depression tells the story of jobless workers and the urban reformers who worked to redeem them. It was an uphill climb: in the 1930’s, workers faced an American culture that was slow to defend the jobless and a federal government that was unwilling to fund the relief they needed, situations that only seemed to reinforce a jobless worker’s feeling of personal failure. As one worker described in Chicago of that year, “I was out of work two years last month. I have never gone for charity. I was ashamed to go.”

In 1932 Chicago reformers rightly sensed, then, that an unemployed worker’s first step toward survival might be the small step of seeing others like them and shedding their sense of shame. Which is why, in Chicago, the newly founded Workers’ Committee on Unemployment (WCOU) hosted seven hearings across the city that allowed workers to tell their stories, and to hear the stories of their neighbors, their landlords, their grocers, and their kids’ teachers. Once workers saw themselves as part of a group, rather than part of the problem, they were able to craft solutions to the economic crisis facing them. As members of the WCOU, workers offered collective action to solve both immediate and long-term problems.

Was a jobless worker’s electricity shut off suddenly, leaving their family in the dark? A formerly employed electrical worker could come turn it back on! Was a family unable to pay rent and thrown on the street? A WCOU member with a truck could help them move! Was a caseworker routinely cutting clients relief funds? The WCOU was there—protesting at the relief site! And were the state and federal governments failing to provide relief where it was highly deserved and much needed? The WCOU was ready to protest—like the 1932 silent march through Chicago.

What emerged from the hearings, the mutual assistance, and the protests was a sense of worker entitlement, or the belief that jobless workers had the right to ask for protection from the state—that when the economy fails, the state is responsible for preserving the dignity and livelihood of those most impacted. As a WCOU pamphlet on declining relief budgets said, “You are entitled to live.… We can not beg all the time. We must ask and demand.”

Unemployment and isolation. These are not unfamiliar concepts for many Americans right now, as the nation has faced unemployment rates between 8-14% since the beginning of the COVID-19 pandemic. Jobless workers in the U.S. have had support in the form of the CARES Act and some stopgap emergency funds, and yet they, too, face questions about how much relief they really need. Debates in Congress over stimulus plans (the Heroes Act and the Heals Act), in which legislation has stalled over how much weekly income the unemployed should receive (ranging between $200 and $600 a week), suggest that either jobless workers have a miraculous economy of thrift or that they earn more than they say. And on October 5 the Wall Street Journal reported that some states are requesting that workers who were inadvertently paid more than they were allotted should return as much as $8,000 to the state.

Workers in 1932 did not have a pandemic to reckon with, but their story is a reminder of the fact that entitlement is not a given, even in the midst of national crisis. As we approach the 2020 election, let us call for a generous entitlement that offers both relief and dignity to the many thousands of Americans who currently feel isolated in their economic insecurity.

Teachers’ unions strike back

This week in North Philly Notes, Lesley Lavery, author of A Collective Pursuit, writes about teachers’ unions’ response to COVID, arguing that despite decades of legal and political effort, teachers’ collective efforts will save lives.

Teachers in Detroit just authorized the first potential “safety strike.” Three week ago, the president of the American Federation of Teachers, the nation’s second-largest teachers’ union, told members that the union’s leadership would support “safety strikes” if health precautions are not met amid calls for schools to reopen as coronavirus cases surge. This declaration of support is striking, not least because it pushes longstanding legal boundaries.

Under current federal statutes, teachers must still report to work even if they believe that local officials have not sufficiently prioritized their health and safety, along with that of their students. The degradation of a teacher’s right to demand such basic and fundamental working conditions is the result of a decades-long effort by education reformers to isolate teachers from their unions—a movement that has praised the individual actions of educators while disparaging their collective calls for higher pay and better working conditions.

An assault on public sector unions began in earnest in 1979 with a unanimous Supreme Court ruling in Abood v. Detroit Federation of Teachers. Attempting to strike a delicate balance between government and individual interests, in Abood the court established a nearly 40 year precedent in teachers’ unions’ ability to collectively bargain by noting a distinction between the unions’ economic and political work.

Following the Abood ruling, teachers and other public employees could not be compelled to join unions so long as they paid the documented costs of contract administration and negotiation. Post-Abood, unions could capture a “fair-share” fee from all potential members but must refrain from spending agency fees on political activities. While in theory this appeased both individuals whose political interests ran counter to their unions’ and unions who might otherwise face a “collective action problem of nightmarish proportions,” in practice, the line between bargaining interests and political interests was difficult to discern, enforce or object to.

Collective_PursuitIn April 2013, after nearly four decades of relative labor peace, ten public school teachers in California, backed by the right-leaning Center for Individual Rights, took a straight shot at the Abood precedent. In Friedrichs v. California Teachers Association, Rebecca Freidrichs and nine California colleagues argued that attempts to separate bargaining from unions’ political actions were moot because bargaining covered so many fundamentally political topics. Like Abood, Freidrichs eventually made its way to the Supreme Court. There, in 2016, the attack on unions stalled following the death of Justice Antonin Scalia. But the reprieve was temporary. On June 27, 2018, a final, decisive blow arrived via Janus vs. American Federation of State, County, and Municipal Employees.  

By February 2018, eulogies for many local teachers’ unions had already been written. But mere months before Janus transformed all states to right-to-work states and those eulogies could be delivered, West Virginia teachers from every one of the state’s fifty-five counties walked out of their classrooms to demand higher wages and showcase their concern regarding a bill to lower teacher-certification standards. West Virginia educators’ activism inspired similar actions in Oklahoma, Arizona, Kentucky, North Carolina, Tennessee and Colorado. School bus drivers then walked off the job in Georgia.

By the end of the year, the AFSCME, Janus’ direct adversary, reported seven new dues-paying-members for each additional non-paying free-rider (a total increase of 22,000 newly organized workers). The AFT added 88,500 members. And though they expected dire defection rates, the National Education Association gained 13,935 members.

The Janus ruling meant to cut unions off at the knees, but as we watch the reopening debate play out right now, it is clear that “reformers’” wins weren’t enough to mollify teachers’ desire to be heard or sever the relationships they’ve been building with their communities. By declaring it too difficult to determine the line between teachers’ economic and political interests, the courts have inadvertently emboldened a generation of educators to take a stand in the debate of their life (pun intended).

Over the summer, as part of an ongoing 12-state 100+ district study on teachers’ unions’ response to COVID-19, my colleague Sara Dahill-Brown (Wake Forest University) and I have interviewed nearly 30 teachers’ union representatives from urban, rural and suburban districts about their involvement in COVID decision-making and planning. Though comfort with plans to “reopen” schools appears to vary based on population density, demographics, decision-making processes (or lack thereof), and the status of school infrastructure, across the country the teachers we’ve interviewed are increasingly desperate for local, state and federal officials to heed their calls to reopen safely.

I spoke with a union leader from a right-to-work district a few weeks ago. After years of struggling to recruit new union members, she and others we spoke with described rapid increases in unsolicited membership. Teachers are asking if they can go on strike. In many locales, they can’t. But they can protest. They can picket. They can stand outside six feet apart with a sign and a red t-shirt on. And they’ve been working diligently for the past several years to ensure that their communities understand teachers’ and students’ shared interests.

Now, with their lives on the line and individual social media posts, letters to administrators and elected officials, and op-eds in local newspapers unanswered, we’ve left teachers with little recourse. Despite decades of legal and political effort, COVID shows that “reformers” have failed to separate teachers from their unions. The union is the only voice that can aggregate and elevate educators’ anxieties and fears and force all of us to take stock of our duties and obligation to children and public education. We must get behind the nation’s teachers and face “COVID-19, a sagging economy and calls for social justice” head on, together.

 

Is now the time to go Under the Knife?

This week in North Philly Notes, Jennifer Graves and Samantha Kwan, coauthors of Under the Knife, write about cosmetic surgery in the age of COVID.

Despite many states banning elective surgeries because of the COVID-19 pandemic, the cosmetic surgery industry is still booming. In fact, some cosmetic surgeons report a rise in patients amid the pandemic. This may be in part because many people are now working from home. Working from home allows people both more flexibility in scheduling procedures and the ability to work while healing. Some surgeons believe working from home has also led to an upswing in business because at-home workers have become increasingly self-conscious as they spend hours on end staring not only at their coworkers, but also at themselves, on various video call platforms like Zoom.

However, perhaps even more importantly, the ability to work from home, combined with the ubiquity of masks, has created an unprecedented chance for cosmetic surgery patients to hide their surgery. Specifically, working from home away from the prying eyes of coworkers and the opportunity to wear a mask in public allows people to conceal the fact that they have had surgery during the conspicuous post-operative healing phase. This ability to pass as surgically unaltered, we found, is paramount to those considering cosmetic surgery.

Under the Knife_smIn our interviews with 46 women who had cosmetic surgery in both Texas and California, it became clear that women who go under the knife are acutely aware of the potential stigma associated with cosmetic surgery. Specifically, they are aware that others may perceive them as fake, preoccupied with vanity, overly sexual, and more. Under the Knife: Cosmetic Surgery, Boundary Work, and the Pursuit of the Natural Fake explores the different ways women negotiate and manage this stigma.

Notably, one of the central ways women do this is by seeking out what we label the “natural fake.” Successful cosmetic surgery that embodies the natural fake means inconspicuous postoperative body parts that appear God-given. The natural fake enables women to pass as surgically unaltered while still conforming to hegemonic ideals of femininity, such as having a flat stomach, ample breasts, and a wrinkle-free face. This ability to pass as surgically unaltered, which is uniquely possible now in the age of COVID-19, helps women avoid any potential stigma they may encounter.

Alongside passing, our participants engaged in “boundary work.” For example, some defended their elective surgery as necessary, positioned their surgeries as “good surgeries” done by competent surgeons for the right reasons, and distinguished themselves from “pathological” cosmetic surgery junkies.

To expose the diverse meanings and experiences that come with cosmetic surgery, Under the Knife also explores the stories of women who exhibited a fraught relationship with cosmetic surgery. Their stories illuminate that cosmetic surgery is not always a cakewalk, and serves as a warning to those who might want to jump into surgery.

Ultimately, in addition to serving as an academic exploration of cosmetic surgery, our work serves as a resource for women contemplating surgery to help them understand the tensions associated with undergoing cosmetic surgery and the nuances of navigating the world in a post-operative body.
